These terms may be updated after legal review.

AveraPayroll LLC (“AveraPayroll,” “we,” “us”) provides payroll and HR onboarding services to businesses. This policy explains how we handle information on averapayroll.com and in our services. Because we process payroll, we handle sensitive personal and financial information, and we follow the privacy and safeguarding principles of the Gramm-Leach-Bliley Act (GLBA) and the FTC Safeguards Rule.
Information we collect
- Website and quote requests: name, company, email, phone, employee and location counts, states, current provider, pay frequency and your message.
- Client business information: legal name, EIN, state tax account numbers, bank account and routing numbers for funding payroll and taxes, and authorized users.
- Employee information provided by our clients or by employees during onboarding: name, address, date of birth, Social Security number, W-4/L-4 and other withholding elections, Form I-9 information and documents, pay rates, hours, tips, deductions, garnishments and direct deposit bank details.
- Technical data: IP address, browser, device and usage logs, and security events.
How we use information
To provide payroll, tax filing and deposit, onboarding and reporting services; to move money as instructed by our clients; to verify identity and prevent fraud; to meet legal, tax and regulatory obligations; to support and communicate with you; and to improve our services. We do not sell personal information and do not use employee data for advertising.
How we share information
Only as needed to provide the services or as required by law: with government tax and labor agencies (IRS, state and local agencies), banks and payment processors that move payroll funds, service providers bound by confidentiality and security obligations (for example, cloud hosting, identity verification and e-signature), the client employer, professional advisers, and as required by subpoena, court order or law. If our business is sold or reorganized, information may transfer subject to this policy.
Data security
We maintain a written information security program designed to protect the confidentiality, integrity and availability of client and employee data, including encryption in transit and at rest, multi-factor authentication, least-privilege and role-based access, audit logging, employee screening and training, vendor oversight, and an incident response plan. If a breach affects your information, we will notify affected clients and individuals as required by applicable law, including the Louisiana Database Security Breach Notification Law. No system is perfectly secure.
Retention
We keep payroll and tax records as long as needed to provide the services and to meet legal recordkeeping requirements (generally at least 4 years for federal employment tax records, and longer where state law or a dispute requires). After that, we securely delete or de-identify data. Quote request information is kept up to 24 months unless you become a client.
Your choices and rights
Employees should contact their employer first to access or correct payroll data; we will assist our clients. You may opt out of marketing email at any time. Residents of certain states may have additional rights; contact us to make a request.
Children
Our website is not directed to children under 13, and we do not knowingly collect their information online.
Changes
We may update this policy and will post the new effective date here.
